On March 13, 1959, Mrs. Mary Becker brought action against the city of La Crosse to recover damages for personal injuries.
The complaint alleged that on July 11, 1958, at about 9:00 p. m., Mrs. Becker was traversing a pedestrian crosswalk at Fourth
and Main streets in downtown La Crosse; that the crosswalk was insufficient, and in want of repair in that the 'black top'
surface had been broken and removed, leaving a jagged, depressed area of approximately three inches in depth; that plaintiff
stepped into the defect, and was thrown violently to the ground upon her knees and elbows so that the patella of both knees
and the radius of her right arm were broken; and that the defect had existed for a long time, and was known to the officers
of the city. The city's answer denied that the crosswalk was insufficient, that the defect had existed for a long time, and that it was
known to the officers of the city. The city's motion for summary judgment was denied by order entered August 28, 1959. The
city appealed.
